NOTICE OF CONSENT TO PERSONAL DATA PROCESSING FOR RECRUITMENT

By submitting an application dossier (“CV/Resume or Job Application”) to Responsible Business Practices Company Limited (“the Company”) through any form or means (at the Company’s office / the Company’s website / email / social media / recruitment websites / postal services / internal referrals, etc.), the Applicant confirms that he/she has fully understood the contents of this Notice on personal data processing (“Notice”) and other policies of the Company relating to information security and personal data protection (if any), and voluntarily consents to the Company and other relevant parties processing the Applicant’s Personal Data for the following purposes:

  • Assessing applicants for recruitment into positions at the Company from time to time
  • Notifying/contacting applicants to discuss their applications in accordance with the Company’s recruitment process from time to time;
  • Informing applicants of job opportunities that are suitable for the Applicant’s Personal Data and that the Company believes may be of interest to the Applicant;
  • Performing the rights and obligations of the Company arising from any contracts or agreements entered into between the Company and the Applicant;

1. Scope of Application

1.1. Personal data means information in the form of symbols, letters, numbers, images, sounds, or similar forms in an electronic environment that is associated with a specific individual or enables the identification of a specific individual. Personal data includes Basic Personal Data and Sensitive Personal Data.

Information that enables the identification of a specific individual means information generated from an individual’s activities which, when combined with other stored data or information, can be used to identify that individual, including but not limited to IP addresses, cookies, job-search behavior data, access devices, or location data.

Personal data provided by the Candidate or the Candidate’s representative to the Company, or collected by the Company, before or during the Candidate’s application for positions being recruited by the Company.

1.2. Basic Personal Data Basic Personal Data means information including: full name (including given name, middle name, and birth name), other names (if any); date, month, and year of birth; date, month, and year of death or missing status; gender; place of birth, place of birth registration, permanent residence, temporary residence, current residence, place of origin, and contact address; nationality; personal images; telephone number; identity card/citizen identification number, personal identification number, passport number, driver’s license number, vehicle registration plate number, personal tax identification number, social insurance number, health insurance card number; marital status; information regarding family members and familial relationships (including parents, children, grandparents, spouse, siblings, parents’ siblings, and other persons having a family relationship); information on an individual’s digital accounts; personal data reflecting activities and activity history in cyberspace; and other personal data associated with or capable of identifying a specific individual.

1.3. Sensitive Personal Data
Sensitive Personal Data means information including: health status and private life recorded in medical records; political opinions and religious beliefs; information relating to racial origin and ethnic origin; information regarding an individual’s physical attributes and unique biological characteristics; bank account information; data concerning an individual’s location when performing certain specific activities; and other personal data classified as Sensitive Personal Data in accordance with applicable laws.

Note: Where the Applicant provides us with Personal Data of any third party (such as family members, referees, or former managers), the Applicant represents and warrants that he/she has obtained the necessary consent or authorization from such third party to share and transfer their personal data to us for processing in accordance with this Notice.

In cases where the Applicant is invited to participate in tests or competency assessments (depending on the requirements of the recruitment position), “Personal Data” shall also include information provided by the Applicant during such tests; answers, assessment results, final outcomes, scores, and personal profile characteristics, including personality traits and soft skills (such as teamwork ability, creativity, decisiveness, reliability, adaptability), reasoning skills, performance, language proficiency, and level of understanding; including audio or video recordings (of which the Applicant has been informed and has consented), or other related information.

2. Methods of Personal Data Processing

Personal data processing refers to one or more operations performed on personal data, such as: collection, recording, analysis, verification, storage, modification, disclosure, combination, access, retrieval, recovery, encryption, decryption, copying, sharing, transmission, provision, transfer, deletion, destruction of personal data, or other related actions.

The Applicant’s Personal Data may be processed in whole or in part and will be stored in the Company’s applicant database system. Only authorized personnel are permitted to access and use such data for the purposes stated in this Notice.

In the event that a candidate is recruited, the candidate’s personal data shall be transferred to the human resources management system and stored as the Company’s personnel data.

3. Reference Check

The Company may conduct background or reference checks directly or engage a third party to carry out such checks on its behalf. Any reference check shall be limited to information relating to your prior employment history or other scope permitted by applicable laws and shall be conducted solely for recruitment purposes.

The Candidate represents and warrants that the Candidate has obtained all necessary consents from their referees for the provision of their information in the Candidate’s application, enabling the Company or its authorized parties to contact such referees and verify the Candidate’s information.

4. Data Retention Period

The Applicant’s Personal Data shall be stored and protected in accordance with the Company’s internal regulations unless otherwise requested by the Applicant or required by applicable law. The data will be deleted when the Company determines that it is no longer necessary, in accordance with legal requirements, or upon the Applicant’s request, except where such Personal Data has been transferred to the human resource management system upon the Applicant’s recruitment. In such case, the Company shall be responsible for storing and protecting the Personal Data in accordance with labor and data protection laws applicable to the Company’s employees.

5. Related Individuals and Organizations and Potential Risks or Unintended Consequences

a. Related Individuals/Organizations

The Company complies with applicable legal requirements to prevent harmful acts or personal data breaches. The Applicant’s Personal Data shall only be shared with individuals or organizations directly involved in the recruitment process or as required by competent state authorities, including but not limited to:

  • Medical examination facilities contracted by the Company for pre-employment health check purposes (depending on the position);
  • Banks for the purpose of opening salary payment accounts for Applicants.

b. Potential Risks or Unintended Consequences

The Company applies necessary technical and legal measures to protect the Applicant’s Personal Data. However, the Applicant acknowledges that no data transmission over the Internet can be guaranteed to be 100% secure.

In the event of risks arising beyond the Company’s reasonable control and not caused by the Company’s fault, the Applicant agrees to waive any claims, complaints, lawsuits, or compensation requests against the Company relating to such risks.

6. Rights and Obligations of the Candidate

The Candidate is responsible for providing complete and accurate information and data, including personal data, as required for recruitment purposes.

The Applicant has all rights and obligations in accordance with applicable laws on personal data protection, including the right to be informed, the right to consent or withdraw consent, the right to request correction, deletion, restriction, or termination of personal data processing, as well as the obligation to protect his/her own personal data and that of others.

7. General Provisions

This Notice constitutes the entire agreement between the Company and the Applicant regarding the processing of personal data and is legally binding. The Applicant’s continued participation in the Company’s recruitment process shall be deemed as acceptance of all contents of this Notice and any amendments or updates (if any).
