Decree No. 337 on Electronic Labor Contracts

Government Decree No. 337/2025/ND-CP, issued on 24 December 2025, is an important legal document detailing regulations on electronic labor contracts and officially takes effect from 01 January 2026. The Decree was promulgated to operationalize provisions of the Labor Code and the Law on Electronic Transactions, meeting the requirements of digital transformation in the labor and employment sector.

Under the Decree, electronic labor contracts are recognized as having legal validity equivalent to paper-based written contracts, provided they fully meet requirements on electronic transactions, electronic signatures, and information security. The conclusion, implementation, amendment, suspension, or termination of labor contracts may all be conducted through the Electronic Labor Contract Platform developed by the Ministry of Home Affairs, contributing to the simplification of administrative procedures and improving management efficiency.

Decree No. 337/2025/ND-CP also clearly defines the responsibilities of employees, employers, e-contract service providers, and state management authorities, while emphasizing requirements for confidentiality, storage, and use of electronic labor contract data. The issuance of this Decree is expected to strongly promote the digitalization of labor relations and ensure the lawful rights and interests of all parties in the context of today’s digital economy.

The regulations on electronic labor contracts will be integrated into RBV’s periodic training courses on labor contracts for participating enterprises, with the aim of supporting the practical implementation of these provisions at company level.
